The California Governor signed AB1020 into law on 10/11/2009 compelling compliance with the Federal Virginia Graeme Baker Pool and Spa Safety Act by 7/1/2010. Failure to comply will result in the closure of your pool and spa and/or a fine. The act is designed to improve pool and spa safety and reduce injuries and fatalities. All public pools at apartment complexes, recreation centers, HOAs, gyms, and therapy centers are subject to the law.
 
At this point, County regulatory agencies (Departments of Environmental Health) are acting as enforcement agents in various capacities. Most Counties are requiring some sort of permit or plan check be submitted. Some Counties are taking a hard stand that non-compliant pools will be closed on 7/1/2010. Others are indicating that as long as your permit application is submitted that you will be allowed to keep your pool open pending completion of the permitted work in a timely manner. None appear to be allowing for latitude in cases where no permit application has been made before the deadline.
 
Commercial Pool and Spa has been at the front lines of the compliance process since early 2008 and we have made hundreds of pools compliant. We have been in frequent contact with regulatory agencies from Ventura, L.A., Riverside, and San Bernardino Counties and we are well aware of their various requirements. Each agency has made variations on their interpretations and staying abreast of those unique requirements is our job.
